Restorative Constitutionalism I: theoretical perspectives

Constitutional scholars have long noted the difference between “preservative“ and “transformative“ modes of constitutionalism. Recent events have also called attention to “abusive“ forms of constitutionalism. But there is also a corralary, under-noticed mode of constitutionalism that is “restorative“ in its aims. This is also a mode of democratic constitutionalism that seems especially important as we grapple with what it means for countries to overcome a recent history of democratic backsliding, or abusive constitutional change. Yet it has received relatively little scholarly attention to date. This panel explores this question – building on recent debates on the topic on https://verfassungsblog.de – by reference to a range of comparative examples, but especially the current challenges facing the US and Eastern Europe.
