SUMMARY:Restorative Constitutionalism I: theoretical perspectives
DESCRIPTION:Constitutional scholars have long noted the difference between “preservative“ and “transformative“ modes of constitutionalism. Recent events have also called attention to “abusive“ forms of constitutionalism. But there is also a corralary\, under-noticed mode of constitutionalism that is “restorative“ in its aims. This is also a mode of democratic constitutionalism that seems especially important as we grapple with what it means for countries to overcome a recent history of democratic backsliding\, or abusive constitutional change. Yet it has received relatively little scholarly attention to date. This panel explores this question – building on recent debates on the topic on https://verfassungsblog.de – by reference to a range of comparative examples\, but especially the current challenges facing the US and Eastern Europe.
