THE TENSION BETWEEN CONSTITUTIONALISM AND DEMOCRACY: SOME PERSPECTIVES

The panel intends to offer space for the discussion of theoretical perspectives regarding the relationship between constitutionalism and democracy. While some theorists understand that this relationship is or can be harmonious, others understand that the synthesis of these two antagonistic traditions is impossible. While on the one hand would be constitutionalism with its capacity to constrict political space, on the other hand democracy carries an unrestricted transformative potential. The panel provides an opportunity for a critical conception of the centrality of the judiciary around the dispute over constitutional signs, while the people play a supporting role when the Basic Law itself is at stake.
