Empirical Methods in Constitutional Law
While constitutional law, and public law more generally, has been in the process of accommodating myriad challenges, methodologies used in constitutional law scholarship have been growing increasingly diverse. This offers interesting opportunities to test methodologies that have not historically been associated with constitutional law. This panel hopes to discuss the place that empiricism has in constitutional law, the scope it offers and potential reasons to exercise caution. It also seeks to discuss the merits of quantitative research methods in the discipline.
