Effectiveness of the Polish Constitution in the context of contemporary challenges
The effectiveness of a constitution must be assessed primarily by its impact on the functioning of the organs of the state and the content of the law enacted. An effective constitution must therefore contain institutional measures that provide “ guarantee of the legality of the levels of law that stand immediately below the constitution“. The effectiveness of the constitution is based on the attitudes of those acting as authorities, i.e. bodies creating sub-constitutional norms and bodies guarding their compliance with the constitution. Does the Polish Constitution meet this criterion of effectiveness in the face of contemporary challenges?
