SUMMARY:Uses and abuses of sovereignty: international order and state powers
DESCRIPTION:Legal scholarship has devoted much attention to the concept of sovereignty. In recent years\, legal scholars have discussed the drawbacks of sovereignty arguments by insisting on overcoming Westphalian accounts of state powers and interstate relationships. There is no shortage of examples of constitutions\, including reference to the primacy of international law. More recently\, sovereignty arguments came to the fore in a radically different fashion: calling for taking back political control over domestic affairs or prioritizing citizens‘ interests. In the wake of the Russian military aggression of Ukraine\, sovereignty arguments are entering a new phase\, one in which sovereignty is at the same time invoked to protect state borders and challenged by the appeal to the international community‘s intervention. Against this backdrop\, the panel discusses sovereignty by identifying claims and arguments animating contemporary debates.
