SUMMARY:The Future of European Data Law: Promises\, Pathologies\, and Problems
DESCRIPTION:The EU has embarked on an ambitious regulatory agenda that seeks to craft new European data laws that gravitate around with but ultimately transcend European data protection law. This panel will explore core concepts and tensions in the evolving European data order. We plan to conduct this panel in a *roundtable format*. The chairs will introduce the core tenets of European Data Law by contrasting existing data law – in particular the General Data Protection Regulation (GDPR) – with the “new kids on the block“: the Data Governance Act (DGA)\, Digital Services Act (DSA)\, Digital Markets Act (DMA)\, Artificial Intelligence Act (AIA)\, and Data Act (DA). Initial interventions by the panelists will be very short to leave plenty of time for discussion. Questions to discuss: How do the new proposals interface with existing European data law? Is there a need to adjust GDPR to achieve the EU‘s regulatory ambitions? To what extent can European data law avoid or mitigate inconsistencies?
