SUMMARY:SOCIAL MEDIA AND NATIONAL COURTS IN EUROPE: A FUNDAMENTAL RIGHTS PERSPECTIVE
DESCRIPTION:In recent years\, we have seen the rise of social networks\, the expansion of blogging\, the development of collaborative knowledge\, and the broad uptake of instant messaging. The digital revolution has expanded the possibilities for individuals to exercise the right to freedom of expression. However\, digitization has also yielded several challenges that have sparked heated debate over regulatory standards in Europe. Less consideration has been given\, however\, to the role of courts in this evolving legal area. As a matter of fact\, national and supranational courts in Europe have been increasingly required to rule on social media disputes. They have done so while operating in a non-social media-specific legal context. The panel will analyse the social media jurisprudence of European and national courts in a couple of EU Member States examining the fundamental rights dimension and instances of judicial dialogue and interaction between the national courts and European supranational courts.
