SUMMARY:Rethinking Representation on the International Bench
DESCRIPTION:This panel builds on the ongoing discussions and interdisciplinary research of the SNF-funded project ‘Diversity on the International Bench: Building Legitimacy for International Courts and Tribunals‘. One of the project goals is to explore how the concept of representation applies to international courts (ICs) and how it can make institutions more democratic\, inclusive\, and legitimate. Dominant works in international law continue to confine representation in ICs to diverse geographical participation or the inclusion of members standing for varied legal cultures and languages. This panel advances these debates by (a) rethinking representation in light of distinct international legal approaches and political theories of representation – (b) exploring the understandings of representation embedded in the institutional design of ICs\, as well as those held by international legal actors throughout history – (c) and discussing the successes and failures of past and present agendas of reform.
