SUMMARY:‘Public Law\, Opposition\, and Loyalty in a Time of Distrust‘
DESCRIPTION:Trust is an increasingly scarce commodity in public law\, both in Europe and further afield. The rise of a new authoritarianism\, frequently (though reductively) described as being ‘populist‘\, which combines formal obedience to the constitution with (the appearance of) democratic legitimacy\, calls into question norms of constitutional law and politics\, democracy\, and the rule of law that in more complacent times may have been thought of as being ‘settled‘. Opposition to the dominant political tendency can all too easily be painted as disloyalty to the constitution\, the state\, or the nation in this new dispensation. The panel seeks to explore the relationship between opposition and loyalty in the European context\, to strategise new ways of thinking about these ideas\, and to assess the role of scholarship as old certainties decay.
