SUMMARY:Democracy\, Populism and the Authority of the Constitution
DESCRIPTION:Authority is more than just the ability to give orders to others – it is an influence on them\, but a legitimate one. The subject who submits to the influence of authority accepts this state of affairs. In this sense\, authority is normative\, acceptable power. Representatives of the legal professions have an authority that is based on their recognition as bearers of knowledge. The community of lawyers can only play its role if the public belief in its neutrality prevails. Undermining the thesis of the neutrality of lawyers – as is systematically done in countries where we see the rise of populism – is at the same time undermining the authority of legal knowledge. The aim of the panel is to examine ways of building authority in constitutionalism through political and academic discourse and its crisis.
