SUMMARY:Contemporary challenges of the Constitutional Court of Ecuador
DESCRIPTION:This panel aims to analyse the judicial activity of the Constitutional Court of Ecuador. When apex courts act as key (veto) players of the democratic game who becomes judge and how they adjudicate\, salient cases are highly consequential in keeping checks and balances within the system. This panel explores how mechanisms that mould the internal composition of apex courts ultimately influence judicial behaviour of judges tasked with guarding the constitution. On the one hand\, the panel conveys how these judges impose checks on the executive by limiting his power during a state of emergency. On the other hand\, the panel offers insights into how the court adjudicates popular referenda as direct democracy mechanisms. These three interesting topics are addressed from the context of a strong constitutional control system within a fragile democracy.
