SUMMARY:Chinese Constitutionalism in Context
DESCRIPTION:While the PRC constitution’s potential to function as hard law is increasing in mainland China\, the legal nature of Hong Kong’s constitutional foundation is increasingly open to question. Is there a convergence in what used to be different visions of constitutionalism within China? This panel explores this potential convergence. It highlights the possibilities and limitations of constitutional review given the dynamics of central-local relations in a vast socialist party state. Yang examines the phenomenon of constitutional restrictions on local legislative authority in China. Huang analyses how grounds of constitutional review could develop\, against the background of the first instance of the PRC Constitution being used to review a provincial regulation. Lo identifies three phases in HK‘s constitutional jurisprudence\, while Zhu tracks the shift in Grundnorm in HK following the 2020 National Security Law’s inception.
